Disputing and Resolution policy

Article 1: Contracting Parties

Transactions conducted via the platform are entered into by:

  1. The First Party (Seller / Service Provider): The entity or individual responsible for providing the product or executing the service.
  2. The Second Party (Buyer / Recipient): The entity or individual receiving the product or service in exchange for the agreed-upon value.

Article 2: Contractual Elements

Any transaction contract concluded through the platform must include the following essential data:

  • A clear and precise description of the contracted goods or services.
  • The total agreed-upon financial value.
  • The approved delivery method and mechanism.
  • The defined timeline for execution and delivery.

Article 3: Delivery and Acceptance Procedures

Upon notifying the platform of the completion of execution, the Second Party is obligated to confirm receipt, which shall result in the following legal consequences:

  1. Acceptance State: The Second Party’s acknowledgment of receipt constitutes final acceptance of the product/service. Consequently, the transaction is closed, and funds are released to the First Party after deducting (WePay) administrative fees.
  2. Objection State (Dispute): In the event of non-conformity with specifications, the Second Party has the right to reject delivery and open a formal "Dispute Ticket," provided they submit:
    • A detailed statement of the reasons for rejection.
    • Supporting physical evidence (photos, documents, time logs, etc.).

Article 4: Jurisdiction of the Dispute Resolution Committee

The (WePay) Dispute Committee shall review requests in accordance with the following regulations:

  • The Committee is committed to issuing its preliminary decision within 48 hours of the date the dispute was initiated.
  • The Committee reserves the right to request additional documents or clarifications from both parties to complete the investigation.
  • Investigation Outcomes:
    • Validation of Claim: The paid amount is refunded to the Buyer (after deducting administrative fees), with the obligation to return the product (if applicable) or pledge not to utilize the service.
    • Rejection of Claim: If the complaint is proven to be unsubstantiated, the payment is released to the First Party (Seller) after deducting fees.

Article 5: Notifications 

  • Both parties shall be notified of the Committee’s decision via the communication channels approved of on the platform.

Article 6: Breach and Sanctions

If it is proven to the platform that a party has engaged in practices involving fraud, gross breach of obligations, or misconduct detrimental to the other party or the platform, (WePay) reserves the right to:

  • Immediately and permanently suspend the violating party’s account.
  • Notify all relevant parties of the details of the violation.
  • Retain the full right to pursue legal action before the competent judicial authorities to recover damages

Article 7: WePay's role in the disputing process 

The Committee's role thus far is limited to resolving disputes based on the facts and evidence presented by both parties, and the Committee's position is not subject to appeal.

In the event that either party to the dispute wishes to take the dispute to judicial or arbitration authorities, the RABATA ALDFE Finance  (WePay) will not be a party to any dispute.
